Public Breastfeeding in Kansas is Protected

Show your support and enroll today!

The KBC’s “Breastfeeding Welcome Here” campaign is aimed at creating welcoming environments where breastfeeding parents can care for their children. In Kansas, 90% of families initiate breastfeeding and are more likely to patronize businesses where they feel comfortable.

Kansas state law 65-1,248 protects a mother’s right to breastfeed in any place she has the right to be.

Additional protections for breastfeeding parents:

Kansas law exempts breastfeeding mothers from jury duty.
In addition to these protections, breastfeeding workers have the right to break time and a private space for pumping during the work day.
Parents traveling by air have the right to transport breast milk through TSA security checks. Breast milk is exempt from the 3-1-1 Liquids Rule.

It also states that it is Kansas public policy for a mother’s choice to breastfeed to be supported and encouraged to the greatest extent possible.

Many Kansas businesses are already providing this level of access and comfort for their patrons. However, there are some businesses and employees that may be unaware of the current law. This can cause an awkward and embarrassing situation for the mother who is simply feeding her child.

To remove businesses that have closed from the list of participating establishments, please email info@breastfeeding.org with the name and address, including county, of the business to remove.

Normal, Accepted, and Welcomed

According to the American Academy of Pediatrics, the lack of support for breastfeeding is one of the obstacles to its success. If our culture embraces breastfeeding as the normal way to feed babies and young children, more women will breastfeed and the health statistics are likely to change for the better.

Do I have to allow women to breastfeed at my business?

Yes. The Kansas law protects a mother’s right to breastfeed in any place that is open to the general public. This includes shopping venues, schools, restaurants, libraries, and public transportation. This law, in part, is based on feeding on cue—one of the key maternity care best practices. Feeding a baby on cue means that a mother is able to nourish and calm her hungry or upset baby. Because milk production works according to supply and demand, feeding on cue also means that mothers will be able to increase and sustain milk production for their growing baby.

How do I respond if a customer complains about a woman breastfeeding?

It’s important to validate concerns as well as educate. A sample response might be:

“I understand you are concerned, but our business complies with Kansas law that protects a mother’s right to breastfeed wherever she has the right to be. As a breastfeeding-friendly business, we support breastfeeding families and will not ask a nursing mother to leave or cover-up. What can I do to make you more comfortable?”

Are there really that many mothers breastfeeding in public?

Yes, 80% of mothers initiate breastfeeding in Kansas. Breastfeeding can be done quite discreetly, so much so that most others around often don’t notice.
